Everyone has the right to health , which is guaranteed by public relations announcements, positions and attitudes, and urges the spread of a healthy culture. Iraqi legislation has enshrined what was stated in declarations of rights, international charters and covenants, as Paragraph 1 of Article 31 of the Constitution of the Republic of Iraq of 2005 guaranteed the preservation of public health, while the amended Penal Code No. 111 of 1969 criminalized acts that would spread dangerous diseases, whether intentionally Or a mistake and by any means, such as spitting the patient on the floor, coughing without a tissue, violating the quarantine, mixing with others, or not adhering to preventive orders and measures, in Articles 368 and 369, as they are considered crimes against public health, which are at the same time crimes of general danger.

The world is witnessing a wave of changes that have taken place at all levels. At the social level, there is an important issue that has recently taken place: the issue of sex change from male to female or vice versa, which may be due to several reasons, including the causes of genital mutilation, psychological reasons and causes of sensuality. The first reasons are the birth of a person with congenital problems in his reproductive system resulting in the inability to live in a proper manner. The psychological reasons are that the person feels that he is a prisoner in a body that does not feel belonging to him. The erotic reasons relate to the anomalous feelings of the person that he wants to change his sex for the purpose of delirious lust only.The change of sex in Iraq is legally governed by the instructions issued by the Iraqi Ministry of Health No. (4) For the year 2002. However, these instructions are not enforced for an unknown reason, although it is one of the first laws regulating the Sexual identity disorder in the Arab world.

The administration assumes many and varied burdens within the framework of the exercise of its activities, and administrative control is one of the most important of these activities, and because it is a preventive system in the first place, it aims to preserve public order and protect basic rights and freedoms under normal or exceptional circumstances, not only at home, but also extending its impact abroad. Through international health cooperation to combat this virus, and therefore the state is obligated to intervene to control and combat everything that affects the public order, whether public security, public peace or public health is not only internally and also grows internationally.
